The fifth issue of the journal В«Intellectual Property in BelarusВ» includes an article В«Orphan works and prospects for their protection in the context of digitalizationВ».
The author is Nadezhda Shakel, Senior Associate at Stepanovsky, Papakul and Partners. Legal Services LLC , Candidate of Legal Sciences, Associate Professor.

New technologies have simplified the creation of works, significantly increasing both their number and the spectrum of their use. In this case, it may be difficult to identify the author or copyright holder of the corresponding copyright object. The article addresses the main options for the legal use of works whose copyright holders are unknown, and outlines the problems associated with this issue. As a result, attention is drawn to the presence in foreign doctrine and practice of the concept of orphan works, the analysis of the possibilities of applying this concept to relevant works in digital form, including those created using artificial intelligence systems.
