Daria Kostyuchenko and Ksenia Pavlova, specialists of the Copyright and Related Rights Department of the National Center of Intellectual Property, shared the peculiarities of the rights distribution when creating works using artificial intelligence during the round table В«Digital Technologies and CopyrightВ», which was held at the National Library of Belarus.
В«Artificial intelligence cannot be legally recognized as an author. However, if the work is created by the user in interaction with artificial intelligence, then the user will be considered as a main author, and artificial intelligence developers can claim a certain share of rights to the work due to a significant contribution to its creation. This approach is regulated by various license agreementsВ», explained D. Kostyuchenko.
K. Pavlova also stressed that the original idea is not generated by artificial intelligence, but by the person who works with it. They formulate questions for the neural network and assign tasks. That, in turn, acts as a program that analyzes this data and makes various decisions based on it.
According to the experts’ opinion, the issue of copyright distribution between artificial intelligence, developers and the user remains complex, but it can be solved taking into account the interests of each side, if the creation process is the result of close interaction between the user and the neural network.
