The author is Elena Logvinovich, a second-year full-time postgraduate student at the Department of Intellectual Property Law at the Belarusian State University and a lawyer of the Minsk Regional Bar Association.
The article examines disputes in the field of intellectual property concerning the specifics of the recovery of compensation and damages for the infringement of exclusive rights to plant varieties. Based on a review of judicial practice, a number of conclusions of doctrinal and practical value are drawn. These conclusions are supported by the provisions of the special legislative acts on intellectual property currently in force in the Republic of Belarus and the Russian Federation.
