Amendments to the PCT Regulations and several of its forms

In accordance with the Rule 89.2(b) of the Patent Cooperation Treaty (PCT) Instruction some modifications will enter into force on July 1, 2024 accompanied by the modifications in some of its forms annexed. Amendments to the Rule 26 and 29 of the PCT Administrative instruction relate to the procedure for handling international applications containing parts in different languages.

Modifications of the PCT Administrative instruction.

The text in Section 305bis(a-bis)(ii) «together with the rest of the record copy» has been excluded so as to explain that the Receiving Office is recommended to immediately send the record copy to the WIPO International Bureau and then upon receipt to furnish its translated copy in accordance with the Rule 26.3ter(e). The Rule 26.3ter(e) in Section 308 is mentioned without the subpoint (e). Moreover, sections 707(b) and 804(a), considered earlier together with the aforementioned sections, have also been amended.

Modifications of several forms annexed to the PCT Administrative instruction.

PCT/RO/117, PCT/RO/150, PCT/RO/157 forms have been modified.

The Form PCT/RO/145 was modified as to specify that this form covers the cases when only parts of the element in question are furnished in another language. The introductory sentence runs now as follows «The receiving Office informs the applicant that the description and the claims, or part thereof, are not in the same language accepted by this receiving Office».
